The Brannon’s Computer Services/Bullet Computers Limited Product Warranty on Brannon’s Computer Services/Bullet Computers Branded Hardware Brannon’s Computer Services/Bullet Computers branded hardware products come with the option for a 90-day, 1-year, 2-year limited product warranty, except as follows:

The following sections detail the terms of the Brannon’s Computer Services/Bullet Computers Limited Product Warranty and Return Policy for the United States, our 30-Day Money Back Guarantee as well as some special considerations for International Orders.

SCOPE OF THE BRANNON'S COMPUTER SERVICES/BULLET COMPUTERS LIMITED PRODUCT WARRANTY:

Brannon’s Computer Services/Bullet Computers warrants to the original purchaser that any Brannon’s Computer Services/Bullet Computers branded hardware will be free of defects in workmanship and materials for the applicable limited warranty period set forth in your packing slip or invoice, which is measured from the date of shipment. Importantly, this limited product warranty does not cover:

Non-Brannon’s Computer Services/Bullet Computers branded hardware products and accessories e.g., monitors, speakers, and most internal hardware items;

Software, including the operating system and software added by Brannon’s Computer Services/Bullet Computers, as well as any third party software;

Product that has been damaged by actions that are beyond Brannon’s Computer Services/Bullet Computers’ control, including for example, impacts, fluids, fire, flood, wind, earthquake, lightning or similar disaster, war, strike, lockout, epidemic, destruction of production facilities, riot, insurrection or material unavailability;

Product that has been damaged through misuse, abuse or mishandling, including without limitation the unauthorized modification of the system as a whole or any individual component, and/or the attachment of peripheral devices;

Product for which Brannon’s Computer Services/Bullet Computers has not received payment;

Or paint and/or finish.

During your applicable limited product warranty period, if a covered product is proven to be defective in workmanship or materials, Brannon’s Computer Services/Bullet Computers will, at its option: (1) replace or repair the defective component; or (2) replace the product with a comparable product. Replacement parts will be new or serviceably used, comparable in function and performance to the original part or product, and warranted for the longer of fourteen days or the remainder of the warranty period. Replacement products may be refurbished, and are warranted for the longer of fourteen days or the remainder of the applicable limited warranty period. Any additional purchases or upgrades will not extend this limited product warranty.

If we determine that the problem with the product is not covered by the limited product warranty, we will inform you of alternative solutions that may be available to you on a fee-for-service basis.

THIS WARRANTY AGREEMENT GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE (OR JURISDICTION TO JURISDICTION). BRANNON’S COMPUTER SERVICES/BULLET COMPUTER SYSTEMS’S RESPONSIBILITY FOR DEFECTS IN BRANNON’S COMPUTER SERVICES/BULLET COMPUTERS BRANDED HARDWARE IS LIMITED TO REPAIR OR REPLACEMENT AS SET FORTH IN THE BRANNON’S COMPUTER SERVICES/BULLET COMPUTERS LIMITED PRODUCT WARRANTY. ALL EXPRESS AND IMPLIED WARRANTIES FOR THE PRODUCT, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN TIME TO THE TERM OF THE LIMITED WARRANTY PERIOD REFLECTED ON YOUR PACKING SLIP OR INVOICE. NO WARRANTIES, WHETHER EXPRESS OR IMPLIED, WILL APPLY AFTER THE LIMITED WARRANTY PERIOD HAS EXPIRED. MOREOVER, BRANNON’S COMPUTER SERVICES/BULLET COMPUTERS’ AND YOUR MAXIMUM LIABILITY TO THE OTHER IS LIMITED TO THE PURCHASE PRICE YOU PAID FOR PRODUCTS OR SERVICES PLUS INTEREST AS ALLOWED UNDER THE APPLICABLE LAW. NEITHER YOU NOR BRANNON’S COMPUTER SERVICES/BULLET COMPUTERS WILL BE LIABLE TO THE OTHER FOR PROPERTY DAMAGE, PERSONAL INJURY, LOSS OF USE, INTERRUPTION OF BUSINESS, “DOWN TIME”, PURCHASER’S TIME, LOSS OF USE OF RELATED EQUIPMENT, LOST PROFITS, LOST DATA OR OTHER CONSEQUENTIAL, INCIDENTAL, PUNITIVE OR SPECIAL DAMAGES, HOWEVER CAUSED, WHETHER FOR BREACH OF WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), ABSOLUTE OR STRICT LIABILITY OR OTHERWISE, OTHER THAN THOSE DAMAGES THAT ARE INCAPABLE OF LIMITATION, EXCLUSION OR RESTRICTION UNDER THE APPLICABLE LAW.

SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS OR THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.

How do I go about receiving service under the Brannon’s Computer Services/Bullet Computers Limited Product Warranty?

How will Brannon’s Computer Services/Bullet Computers fix a defective, warranted product?

For all covered products, we will first attempt to diagnose and resolve the problem over the telephone. If we determine that the problem is with a defective component covered by your warranty, then we will, at our option, either: (a) have you send your product to our repair facilities for repair or replacement; (b) send a technician to your home or place of business to replace the defective component; or (c) send you a component part to replace the defective component. Option (b) will apply only if you purchased the Brannon’s Computer Services/Bullet Computers Onsite Service along with your warranty.

If our technical support agents determine that your product must be returned to our facilities for repair or replacement, we will issue you a Return Material Authorization Number. We will then send you a shipping label for shipping your product, at our expense, to our facilities. You must, however, return the product to us in its original or equivalent packaging. We will, at our expense, return the repaired or replacement product to you. We will pay shipping expenses both ways only if you use an address in the United States (excluding Puerto Rico and U.S. possessions and territories). Otherwise, you are responsible for shipping the product to our Repair Facility and we will ship the product back to you freight collect.

Brannon’s Computer Services/Bullet Computers also offers, along with its Limited Product Warranty, the possibility of onsite replacement of defective components. Please check your invoice to see if your warranty includes onsite replacement. If we, Brannon’s Computer Services/Bullet Computers agree that a system component(s) should be replaced by an onsite technician, we will then send the replacement part(s) to you and request that you send us back the defective component(s). We will require a valid credit card number at the time you request a replacement part under this option, but will not charge you for the replacement part as long as you return the original part to us within five (5) days after you receive the replacement part. If we do not receive the original part within five (5) days from the date you received the replacement part, we will charge to your credit card the then-current standard price for that part. IMPORTANT NOTE: Before you ship product to us or before you replace a part, make sure to back up the data on the hard drive(s) and any other storage device(s) in the product(s). Remove any confidential, proprietary, or personal information and removable media such as floppy disks, CDs, or PC Cards. We are not responsible for any of your confidential, proprietary, or personal information; lost or corrupted data; or damaged or lost removable media.

30-DAY LIMITED MONEY BACK GUARANTEE:

We take pride in the quality of the products that we sell and, as a direct result, offer a 30-day money back guarantee on all Brannon’s Computer Services/Bullet Computers hardware, accessories, peripherals and unopened software still in its/their original sealed packaging. Shipping and handling fees are not refundable. Also, a fifteen percent (15%) restocking fee may be deducted from your refund or credit. To return merchandise, you must obtain a Return Materials Authorization number. Please call the Brannon’s Computer Services/Bullet Computers customer service department and provide them with the invoice number, item description, and serial number(s) of the merchandise you wish to return. You must ship the merchandise within five (5) days of receiving your RMA number. Moreover, you must also return the merchandise to Brannon’s Computer Services/Bullet Computers in its/their original packaging, in as-new condition along with any media, documentation, and all other items that were included in the original shipment, prepay shipping charges, and insure the shipment or accept the risk of loss or damage during shipment.

STANDARD TERMS AND CONDITIONS FOR SALE AGREEMENT

This Standard Terms and Conditions for Sale Agreement (“Agreement”) contains the terms and conditions that apply to any order, purchase, receipt, delivery or use of any products from Brannon’s Computer Services/Bullet Computers or any of its subsidiaries or affiliates (collectively, “Brannon’s Computer Services/Bullet Computers”). By accepting delivery of the product(s) purchased from Brannon’s Computer Services/Bullet Computers and described on your invoice, you agree to be bound by and accept the following terms and conditions. Any attempt to alter, supplement or amend this document or to enter an order for a product(s) that is subject to additional or altered terms and conditions will be null and void, unless otherwise agreed to in a written agreement signed by both you and Brannon’s Computer Services/Bullet Computers. These terms and conditions are subject to change without prior written notice at any time, at Brannon’s Computer Services/Bullet Computers‘ sole discretion.


1. Definitions.

1.1 "We", "us" and/or "our" means Brannon’s Computer Services/Bullet Computers.

1.2 "You" or "your" means the individual or entity named on the invoice.

2. Payment Terms, Orders, and Interest. Advertised prices are in U.S. dollars and, unless otherwise noted, exclude shipping, handling and any taxes that may be imposed by the legal authority that governs the jurisdiction in which you reside. We reserve the right to cancel an order or transaction, in whole or in part. Terms of payment are within Brannon’s Computer Services/Bullet Computers’ sole discretion, and unless otherwise agreed to in writing by Brannon’s Computer Services/Bullet Computers, payment must be received by Brannon’s Computer Services/Bullet Computers before Brannon’s Computer Services/Bullet Computers’ acceptance of an order. Invoice amounts are due and payable within the period noted on the invoice, measured from the date of the invoice. Brannon’s Computer Services/Bullet Computers may invoice parts of an order separately. You agree to pay interest on all past-due sums at the highest rate allowed by law. Brannon’s Computer Services/Bullet Computers is not responsible for pricing, typographical or other errors in any offer by Brannon’s Computer Services/Bullet Computers and we reserve the unilateral right to cancel any orders resulting from such errors.

3. Taxes. Unless you provide Brannon’s Computer Services/Bullet Computers with a valid and correct tax exemption certificate applicable to your purchase of Product and the Product ship-to location, you are responsible for sales and other taxes associated with the order.

4. Shipping, Title and Risk of Loss. Shipping and handling are additional unless otherwise expressly indicated at the time of sale. Loss or damage that occurs during shipping by a carrier selected by Brannon’s Computer Services/Bullet Computers is Brannon’s Computer Services/Bullet Computers’ responsibility. Loss or damage that occurs during shipping by a carrier selected by you is your responsibility. Title to software remains with the licensor of the software. Your use of software is subject to license agreements applicable to the software. Shipping dates are only estimates. You must notify Brannon’s Computer Services/Bullet Computers of damaged or missing items from your order within fourteen (14) calendar days after you receive your product.

5. Return Policy. You may return Brannon’s Computer Services/Bullet Computers-branded products purchased directly from Brannon’s Computer Services/Bullet Computers in accordance with Brannon’s Computer Services/Bullet Computers’ Return Policy, which may be viewed before the beginning of the Standard Terms and Conditions for Sale Agreement. Please keep in mind that, among other things, you: (a) must contact us directly before you attempt to return the product; (b) must return the product to us in its original or equivalent packaging; and (c) are responsible for risk of loss and shipping and handling fees for returning or exchanging product. Additional fees may apply.

6. Limited Product Warranty for Domestic Customers and Disclaimer of Warranties. THE LIMITED PRODUCT WARRANTY APPLICABLE TO BRANNON’S COMPUTER SERVICES/BULLET COMPUTERS-BRANDED PRODUCTS MAY BE VIEWED BEFORE THE BEGINNING OF THE STANDARD TERMS AND CONDITIONS FOR SALE AGREEMENT. THERE ARE NO WARRANTIES FOR SOFTWARE, SERVICES OR NON-BRANNON’S COMPUTER SERVICES/BULLET COMPUTERS BRANDED PRODUCTS, WHICH PRODUCTS AND SERVICES ARE PROVIDED “AS IS”. WARRANTY AND SERVICE FOR NON-BRANNON’S COMPUTER SERVICES/BULLET COMPUTERS BRANDED PRODUCTS, IF ANY, ARE PROVIDED BY THE ORIGINAL MANUFACTURER, AND NOT BY BRANNON’S COMPUTER SERVICES/BULLET COMPUTERS. BRANNON’S COMPUTER SERVICES/BULLET COMPUTERS MAKES NO WARRANTIES, EXPRESS OR IMPLIED, EXCEPT THOSE STATED IN THIS SECTION AND IN BRANNON’S COMPUTER SERVICES/BULLET COMPUTERS’ APPLICABLE WARRANTY STATEMENT IN EFFECT ON THE DATE OF THE INVOICE. ANY SUCH WARRANTY WILL BE EFFECTIVE DURING THE RELEVANT PERIOD, AND BRANNON’S COMPUTER SERVICES/BULLET COMPUTERS WILL BE OBLIGATED TO HONOR ANY SUCH WARRANTY ONLY UPON BRANNON’S COMPUTER SERVICES/BULLET COMPUTERS’ RECEIPT OF PAYMENT IN FULL FOR THE ITEM TO BE WARRANTED.

7. LIMITATION OF LIABILITY. BRANNON’S COMPUTER SERVICES/BULLET COMPUTERS DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET FORTH HEREIN, INCLUDING ANY LIABILITY FOR PRODUCTS NOT BEING AVAILABLE FOR USE, FOR LOST OR CORRUPTED DATA OR SOFTWARE, OR THE PROVISION OF SERVICES AND SUPPORT. BRANNON’S COMPUTER SERVICES/BULLET COMPUTERS WILL NOT BE LIABLE FOR LOST PROFITS, LOSS OF BUSINESS OR OTHER CONSQUENTIAL, SPECIAL, INDIRECT OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY EXCEPT AS EXPRESSLY PROVIDED HEREIN. YOU AGREE THAT FOR ANY LIABILITY RELATED TO THE PURCHASE OF PRODUCTS OR SERVICES BUNDLED WITH THE PRODUCTS, BRANNON’S COMPUTER SERVICES/BULLET COMPUTERS IS NOT LIABLE OR RESPONSIBLE FOR ANY AMOUNT OF DAMAGES ABOVE THE AGGREGATE DOLLAR AMOUNT YOU PAID FOR THE PURCHASE GOVERNED BY THIS AGREEMENT.

8. Software. All software is provided subject to the license agreement that is part of the package you receive from Brannon’s Computer Services/Bullet Computers. You agree to be bound by the license agreement once the package is opened or its seal is broken. Brannon’s Computer Services/Bullet Computers does not warrant any software under this Agreement.

9. Products. Brannon’s Computer Services/Bullet Computers continually upgrades and revises its products and service offerings. Brannon’s Computer Services/Bullet Computers may revise and discontinue products at any time without prior notice to customers. Brannon’s Computer Services/Bullet Computers will ship products that have the functionality and performance of the products ordered, but changes between what is shipped and what is described in a specification sheet are possible. The parts and assemblies used in building Brannon’s Computer Services/Bullet Computers products are selected from new and equivalent-to- new parts and assemblies in accordance with industry practices. Spare parts may be new or reconditioned. The quoted Brannon’s Computer Services/Bullet Computers SKU numbers for Brannon’s Computer Services/Bullet Computers-branded hardware products are of the quality specified by Brannon’s Computer Services/Bullet Computers on its website and conform in all material respects with the Brannon’s Computer Services/Bullet Computers product specification current on the date such products were shipped.

10. Binding Arbitration. You and Brannon’s Computer Services/Bullet Computers agree that any claim, dispute or controversy, whether in contract, tort or otherwise, and whether preexisting, present or future, and including statutory, common law, intentional tort and equitable claims (“Dispute”) against Brannon’s Computer Services/Bullet Computers, its shareholders, directors, employees, agents, successors, assigns or affiliates arising from, in connection with or relating to this Agreement, its interpretation, or the breach, termination or validity thereof, the relationships which result from this Agreement (including, to the full extent permitted by applicable law, relationships with third parties who are not signatories to this Agreement), Brannon’s Computer Services/Bullet Computers’ advertising or any related purchase SHALL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION ADMINISTERED BY THE NATIONAL ARBITRATION FORUM (available via the Internet at http://www.arb-forum.com, or via telephone at 800.474.2371) under its Code of Procedure then in effect. This transaction involves interstate commerce, and this provision shall be governed by the Federal Arbitration Act 9 United States Code, sections 1-16. Any award of the arbitrators shall be final and binding on each of the parties, and may be entered as a judgment in any court of competent jurisdiction. YOU UNDERSTAND THAT, IN THE ABSENCE OF THIS PROVISION, YOU WOULD HAVE HAD A RIGHT TO LITIGATE DISPUTES THROUGH A COURT, INCLUDING THE RIGHT TO LITIGATE CLAIMS ON A CLASS-WIDE OR CLASS-ACTION BASIS, AND THAT YOU HAVE EXPRESSLY AND KNOWINGLY WAIVED THOSE RIGHTS AND AGREED TO RESOLVE ANY DISPUTES THROUGH BINDING ARBITRATION IN ACCORDANCE WITH THIS SECTION.

11. Applicable Law and Not for Resale. You agree and represent that you are buying the products governed by this Agreement for your own use and not for resale.

12. Governing Law. This Agreement and any sales hereunder shall be governed by the laws of the state of Arkansas, without regard to conflicts of laws principles, and excluding the United Nations Convention on the International Sale of Goods.

13. Export. You acknowledge that the purchased goods licensed or sold under this Agreement, and the transaction contemplated by this Agreement, which may include technology and software, are subject to the customs and export control laws and regulations of the United States, and may also be subject to the customs and export laws and regulations of the country in which the products are manufactured and/or received. Further, under United States law, the goods shipped pursuant to this Agreement may not be sold, leased, or otherwise transferred to restricted countries or utilized by restricted end-users or an end-user engaged in activities related to weapons of mass destruction, including activities related to the design, development production or use of nuclear weapons, materials, facilities, missiles or the support of missile projects, and chemical or biological weapons. You agree not to provide any written regulatory certifications or notifications on behalf of Brannon’s Computer Services/Bullet Computer Systems. Brannon’s Computer Services/Bullet Computer Systems has not tested product for use in high-risk activities including any life sustaining, chemical, or mission critical use. BRANNON’S COMPUTER SERVICES/BULLET COMPUTERS WILL NOT HAVE ANY LIABILITY FOR ANY DAMAGES ARISING FROM THE USE OF THE PRODUCTS IN ANY HIGH RISK ACTIVITY, INCLUDING THE OPERATION OF NUCLEAR FACILITIES, AIRCRAFT NAVIGATION OR COMMUNICATION SYSTEMS, AIR TRAFFIC CONTROL, MEDICAL SYSTEMS, LIFE SUPPORT OR WEAPONS SYSTEMS.

14. Miscellaneous Provisions. You will not register or use any Internet domain name that contains a Brannon’s Computer Services/Bullet Computers trademark or trade name (i.e., Brannon’s Computer Services/Bullet Computers) in whole or in part or any other name that is confusingly similar thereto. The section headings used herein are for convenience of reference only and do not form a part of these terms and conditions, and no construction or inference shall be derived therefrom. If any term of this Agreement is found by a court of competent jurisdiction to be unenforceable, the enforceability of the remaining provisions shall not be affected or impaired.
